Terms of service

The plain-English rules for working with me and for using this website. If you hire me, these apply together with whatever we agree in writing for your project.

About these terms

“Club”, “I” and “me” mean the independent web developer who runs this site and can be reached at [email protected]. “You” means the person or business hiring me or browsing this site.

By hiring me or using this site you agree to these terms. If something we agreed in writing for your project says otherwise, that agreement wins.

You need to be at least 18, or have a parent or guardian agree on your behalf, to hire me.

Quotes and scope

Before I start, you get a quote that says what I will build, what it costs and roughly how long it should take. Work begins once you accept it in writing. A message or an email counts.

Anything outside the agreed scope is extra work. I will tell you the cost before doing it.

Payment

The price, the payment schedule and the payment method are set out in your quote. Unless the quote says otherwise, the final files and the launch are handed over once the project is paid in full.

If a payment is late I may pause the work until it arrives.

What I need from you

To finish on time I need your text, images, logins and feedback when I ask for them.

You confirm that you have the right to use everything you send me, including logos, photos, copy and any reviews or testimonials, and that it is accurate and lawful. If someone makes a claim because of material you supplied, that claim is yours to deal with and to cover.

If I build a leaderboard, competition or giveaway page for you, I build the page; you run the promotion. The rules, the prizes, paying winners, any sponsor or affiliate disclosures, age limits and making sure the promotion is legal where your audience lives are your responsibility.

Revisions

Revisions are included during the build, within the scope we agreed. Changes that go beyond that scope, or that are requested after launch, are quoted separately.

Timelines

Dates I give are honest estimates, not guarantees. They can move if the scope changes, if I am waiting on content, feedback or payment from you, or because of things outside my control such as illness or a service outage. I will tell you as soon as I know a date is at risk.

Ownership

Once the project is paid in full, the finished website and the custom code and design I made for it are yours.

I keep the right to reuse general techniques, snippets and tools that are not specific to your project. Open-source libraries and fonts stay under their own licences.

Mentioning the work

I may say that I built your site. If you would rather I did not, tell me and I will keep it private.

Confidentiality

I keep your logins, unreleased plans and other private information confidential, use them only for your project, and do not pass them on unless you ask me to or the law requires it.

Third-party services

Your site may rely on services I do not run, such as hosting, domains, fonts or code libraries. Their prices, uptime and terms are theirs. I am not responsible for outages or changes on their side.

After launch

I fix genuine bugs in my own work that are reported within 14 days of launch, at no charge. Ongoing maintenance, new features and content updates are separate work unless your quote includes them.

Cancelling and refunds

Either of us can end a project by telling the other in writing. You pay for the work done up to that point, and I hand over that work once it is paid for.

Payment for work already done is not refundable. If you have paid for work I have not started, I refund that part.

Work I will not take on

I do not build sites that are illegal, that infringe someone else's rights, or that are designed to deceive or harm people. If a project turns out to be one of those, I can stop and the cancelling rules above apply.

No guarantees and liability

I build carefully, but I cannot promise that a website will be free of every error, or that it will bring in a particular amount of traffic, ranking or sales.

To the extent the law allows, my total liability for a project is limited to the amount you paid me for it, and I am not liable for indirect losses such as lost profit, lost business or lost data. Keeping backups of your own content is your responsibility.

Your legal rights

Nothing in these terms takes away rights you have under the law of the country you live in that cannot be excluded by agreement, including consumer protection rights. Nothing here limits liability for fraud, or for anything else that cannot legally be limited.

Using this website

This site, its design, text, logo and code belong to me. You are welcome to look around and get in touch. Please do not copy it wholesale, or try to break or misuse it.

The site is provided as it is. The demos on it are illustrations: the leaderboard players, scores and charts are made-up sample data, not real people or real results.

Credits and licences

This site uses the following open-source work, each under its own licence:

  • Lexend Exa and Hanken Grotesk typefaces, under the SIL Open Font Licence
  • Lenis smooth-scroll library by darkroom.engineering, under the MIT licence

Accessibility

I want this site to work for everyone, including with a keyboard, a screen reader and reduced-motion settings. If something gets in your way, email [email protected] and I will fix it.

Law and disputes

If something goes wrong, tell me first and I will try to put it right. If we still cannot agree, the laws of the country where I am based apply and its courts decide, except where the law of the country you live in gives you the right to bring a claim there.

General

These terms and your quote are the whole agreement between us. If one part turns out to be unenforceable, the rest still stands. I work as an independent contractor, not as your employee or partner.

Changes to these terms

I may update these terms from time to time. The date at the top shows the latest version. A project that has already started stays on the terms it began with.
